IMPACTCONNECT VOIP SERVICE SCHEDULE

IMPACTCONNECT VoIP SERVICE SCHEDULE

1/1/2019

Vancouver Telephone Company Limited (also referred to as “VTC” or "Impact Telecom" herein) offers its ImpactConnect VoIP Services pursuant to the VTC Residential and Small Business Terms and Conditions ("VTC Terms and Conditions"), which are incorporated into this ImpactConnect VoIP Service Schedule. You must read this ImpactConnect VoIP Service Schedule together with the VTC Terms and Conditions to understand the terms and conditions of your ImpactConnect VoIP Service. If there is any conflict between the VTC Terms and Conditions and the provisions set forth in this Service Schedule, the terms of this Service Schedule shall control.

1. SERVICE DESCRIPTION
The ImpactConnect voice over Internet Protocol Service is a residential enhanced voice communication service that converts voice communications into Internet Protocol (IP) packets that are carried over Impact Telecom's IP network ("Service"). It may be referred to as "voice over IP" or "VoIP." The Service includes direct-dialed calling, telephone number(s), and call management features or advanced features, which may be offered at additional cost. If the Service is fixed, it will function only in your home or home office. If the Service is mobile or nomadic, it may function from any location where you can connect your device to a high-speed internet access service, broadband or DSL line. Our service may be subject to different regulatory treatment than traditional voice telecommunications service. This treatment may limit or otherwise affect your rights of redress before regulatory agencies.
We may list subscriber names and telephone numbers in printed directories and/or directory assistance databases, or may offer to withhold same from printed directories and/or directory assistance databases at additional cost.
Impact Telecom charges an additional monthly fee for international (non-Canada) direct inward dial phone numbers ("DID") for those customers who wish to order that feature. Monthly fees for international DID numbers vary and are available from Impact Telecom's Customer Service Department. Customers that have international DIDs are provided with these numbers based on current Canadian and overseas regulations. These regulations are subject to change without notice and Impact Telecom may be required to discontinue this Service, without notice. Impact Telecom reserves the right to discontinue International DID services for any reason at any time and is only obligated to refund the pro-rated monthly fee.
The Add-on CellConnect feature allows you to access domestic and international long distance services from your mobile or any other phone through local or toll free numbers.
Special applications for the use of your VoIP Service from your mobile telephones, computers, smartphones, PDA's, tablets or pads can be purchased from Impact Telecom or from authorized manufacturers.
Impact Telecom, in its sole discretion, may add, modify, or delete components of the VoIP Service from time to time.

2. FACILITIES AND EQUIPMENT PROVIDED BY CUSTOMER
The ImpactConnect VoIP service may require a regular touchtone landline telephone, which you must supply and which must be connected to an analog telephone adapter (“ATA” or “Vox Box”) to be provided by Impact Telecom, for which a cost may be charged, depending on plan.
Some of our other services may be used with devices such as mobile telephones, computers, smartphones, PDA's, tablets or pads which you will be required to provide.
IN ORDER TO USE THE SERVICE, YOU MUST HAVE HIGH-SPEED INTERNET SERVICE, BROADBAND OR DSL, WHICH IS NOT A PART OF THE SERVICE. You are responsible for subscribing and paying for your high-speed Internet access, broadband or DSL in order to use your Service. The quality of your Service is highly dependent on the data speed, quality and reliability of your high-speed Internet, broadband or DSL connection. It is your responsibility to report and resolve any quality and connectivity issues related to your high-speed Internet, broadband or DSL connection with your provider.
For certain mobile applications, a WiFi or other data connection (e.g. 3G/4G or LTE) is required, which we do not provide.

3. REGISTERED ADDRESS; FIXED VS. NOMADIC VOIP SERVICE
We require you to provide the physical address (“Registered Location”) where you will be using our VoIP Service for 911 purposes. For E911 and basic 911, this address is used to route 911 calls to your local emergency center. When you initially provide your Registered Location, it can take up to 120 minutes to verify your address and activate 911 service at this address.
VoIP Service can be fixed or nomadic. If you subscribe to a fixed VoIP Service, you agree that neither you nor a third party will move your Equipment used for the ImpactConnect VoIP Service to any other physical location outside of the Registered Location where it was installed. ImpactConnect VoIP fixed service is not designed to be nomadic and will not function properly if the Equipment is moved or altered. If you require the Equipment to be moved, you must contact Impact Telecom. Failure to do so may result in a failure of the Service and/or in Impact Telecom's termination of your Service.
If you subscribe to a nomadic ImpactConnect VoIP Service, remember that, unlike traditional telephone services, ImpactConnect VoIP service is portable to any location with high speed Internet access. For example, you can have a Toronto number and receive calls in Calgary. You can also take your equipment with you on a trip but, when you travel, unless your 911 call is made from inside Canada, the operator will not be able to route your call to the appropriate emergency personnel. If you subscribe to nomadic VoIP Service, if you move the VoIP Equipment or device to another location, you must update your Registered Location. You may register only one Registered Location at time. If you do not update your location, your 911 calls may be sent to an emergency center near your old Registered Location. When you update your location, it can take several hours to activate 911 service at the updated address.

4. SERVICE LIMITATIONS
IMPORTANT SERVICE LIMITATIONS APPLY TO 911 AND E911 CALLS. (See the Section 10. below titled “IMPACTCONNECT VOIP SERVICE 911 LIMITATIONS”)

IMPACTCONNECT ACCEPTABLE USE

You acknowledge that Impact Telecom may establish general practices and limits concerning acceptable use of the ImpactConnect VoIP Service, including without limiting other limitations set forth in these Terms or otherwise. ImpactConnect VoIP Service cannot be used to make or receive 0+ or operator-assisted calls, including collect or third-party billing calls, nor can ImpactConnect VoIP service be used to make 900/976 calls; calling card calls, area code 500, 700, and 710 calls; 10-10-XXX dial-around calls; or international operator or directory assistance calls. Additionally, any use of the Service that is deemed to be unlawful or illegal, as well as for fraudulent purposes are not permitted and Impact Telecom reserves the right to terminate or suspend the Services should it discover any such use. Also, the ability to call certain N11 services (211, 311, 511 and other x11) may not be available in one or more service areas.
Impact Telecom's residential service is intended for single family use and is not intended for multi-family or extended family use. As such, the use of the Service should be limited to the Customer and those family members, residents, or guests of the registered location(s) of the Customer. The residential ImpactConnect plans are designed to deliver and satisfy use that is consistent with calling patterns of single family residential usage within each plan. These residential plans are not to be utilized for commercial use or marketing services (including telemarketing, fax or voice mail blasts, conference type calling).
Impact Telecom monitors the usage patterns of customers to ensure that the ImpactConnect Services are not being utilized in a way that is not consistent with the acceptable use of the Services. This may include reviewing the account for short duration or frequent calling patterns, which may be indicative of abnormal or excessive use of the Service. In determining abuse of the Service by a Customer, Impact Telecom compares the normal calling patterns and usage of other customers with similar plans. For example, the majority of similarly situated ImpactConnect residential customers with “Unlimited” service plans have an average minutes of use for all the services that does not exceed 3000 minutes of use per month, nor do they exhibit the type of calling patterns that are indicative of abuse.
Impact Telecom reserves the right to move Customers who are found to be in violation of this acceptable use to another plan that fits their actual use of the Services or terminating the Customer’s Service. However, Impact Telecom shall make commercially reasonable efforts to notify Customer of suspected abuse and allow the Customer the opportunity to correct its abusive or excessive calling patterns. Should Customer continue or repeat violations of acceptable use or violate other terms of this Service Schedule, Impact Telecom may immediately suspend or terminate the Services.
Our Service may support specified dialing such as 411, although certain mobile applications may not provide such dialing services. 411 charges may vary by plan.
Impact Telecom also limits the maximum number of days that messages will be retained; the maximum number messages that will be retained by the Service; the maximum size of any message; and the maximum disk space that will be allotted on Impact Telecom's servers on your behalf. You agree that Impact Telecom will have no responsibility or liability for the deletion, for failure to store or to deliver any messages and other communications, for the modification or malformation of communications over the ImpactConnect VoIP Service, or for other content maintained or transmitted by ImpactConnect VoIP Service. You acknowledge that Impact Telecom reserves the right to log off accounts or disconnect sessions that are inactive for an extended period of time. You further acknowledge that Impact Telecom reserves the right to change these general practices and limits at any time without advance notice.

5. INCOMPATIBILITY WITH OTHER SERVICES
You acknowledge that our service may not be compatible with all non-voice communications equipment, including but not limited to home security systems, TTY, medical monitoring equipment, certain versions of TiVo, AOL, Netflix and other streaming services, cable television services, FiOS, satellite television systems, PBX, Centrex, other private telephone networks, or computer modems. You waive any claim against Impact Telecom for interference with or disruption of these services and equipment, as well as any claim that Impact Telecom is responsible for any disruption to your business, if applicable.
Some providers of broadband service may provide modems that prevent the transmission of communications using our service. We do not warrant that our services will be compatible with all broadband services and expressly disclaim any express or implied warranties regarding the compatibility of our service with any particular broadband service.

6. INTERRUPTIONS
Since voice over IP is dependent on the IP network, the availability of an adequate power supply, and correct Equipment configuration, Impact Telecom does not guarantee that ImpactConnect VoIP service will be continuous or error-free. You acknowledge and understand that Impact Telecom cannot guarantee that voice over IP communication is completely secure.

7. BACK-UP POWER
Power Outages and Backup Batteries. YOU ACKNOWLEDGE AND UNDERSTAND THAT IMPACTCONNECT VOIP REQUIRES ELECTRICAL POWER TO FUNCTION AND THAT YOU THEREFORE MUST AT ALL TIMES MAINTAIN A WORKING BACKUP BATTERY FOR YOUR EQUIPMENT. YOU ACKNOWLEDGE AND UNDERSTAND THAT IT WILL TAKE APPROXIMATELY 18 HOURS OR MORE TO CHARGE AN INITIAL BACKUP BATTERY AFTER VOIP SERVICE IS INSTALLED AND/OR AFTER A REPLACEMENT BATTERY IS INSTALLED. YOU ACKNOWLEDGE AND UNDERSTAND THAT TO CONSERVE BATTERY POWER DURING A POWER OUTAGE, YOU SHOULD NOT ATTEMPT TO USE THE BACKUP BATTERIES FOR ANY PURPOSE OTHER THAN TO POWER YOUR VOIP SERVICE (OR TO POWER YOUR INTERNET CONNECTION).
YOU ACKNOWLEDGE AND UNDERSTAND THAT THE BACKUP BATTERIES DO NOT PROVIDE POWER FOR CORDLESS PHONES AND THAT, IF YOU ARE USING A CORDLESS PHONE WITH YOUR IMPACTCONNECT VOIP SERVICE, A SEPARATE BACKUP BATTERY OR OTHER POWER SOURCE MAY BE REQUIRED IF THERE IS A POWER OUTAGE. YOU ACKNOWLEDGE AND UNDERSTAND THAT YOU ARE SOLELY RESPONSIBLE FOR DETERMINING WHEN THE EQUIPMENT AND BACKUP BATTERIES REQUIRE REPLACEMENT AND FOR REPLACING AND RECYCLING USED BATTERIES IN ACCORDANCE WITH MANUFACTURER OR VENDOR DIRECTIONS. YOU ALSO ACKNOWLEDGE AND UNDERSTAND THAT YOU ARE SOLELY RESPONSIBLE FOR OBTAINING AND MAINTAINING BACKUP BATTERIES OR OTHER SOURCES OF POWER FOR ANY CORDLESS PHONES YOU USE WITH YOUR VOIP SERVICE.

8. CHARGES, FEES AND TAXES

9. TERMINATION OR SUSPENSION OF SERVICE
We may suspend or terminate your ImpactConnect VoIP Service subject to the terms specified in the VTC Telecom Terms and Conditions or this Service Schedule.
Without limiting other rights set forth in this Service Schedule, Impact Telecom may either terminate your ImpactConnect VoIP Service or transfer your ImpactConnect VoIP Service to a different telephone number without penalty, upon commercially reasonable notice, if Impact Telecom stops providing ImpactConnect VoIP Service either generally or in your area, if at any time 911 service over ImpactConnect VoIP Service is not available, or for other reasons associated with the provisioning of 911 service to your premises. Impact Telecom also may terminate your order for Service if you do not activate the Service within 90 days or if you do not formally acknowledge information about 911 Service limitations in accordance with directives from Impact Telecom.
Service suspension may, and cancellation will, result in your loss of the number associated with the ImpactConnect VoIP Service and may impact components of your Service. Impact Telecom has no responsibility for retaining or delivering messages that are located in any voice mailbox at the time of the suspension or termination, or that are addressed to any main account holder or subaccount holder thereafter.

10. IMPACTCONNECT VOIP SERVICE 911 LIMITATIONS
ImpactConnect VoIP 911 service is different from traditional wireline 911 and cellular/wireless 911.
As noted above, we require you to provide the physical address (“Registered Location”) where you will be using our VoIP Service for 911 purposes. For E911 and basic 911, this address is used to route 911 calls to your local emergency center.
When you initially provide your Registered Location, it can take up to 120 minutes to verify your address and activate 911 service at this address. (See Section 3 “Registered Address; Fixed vs. Nomadic VoIP Service above.”)
If you move this device to another location, you must update your address. You may register only one location at time. If you do not update your location, your 911 calls may be sent to an emergency center near your old address. When you update your location, it can take several hours to activate 911 service at the updated address. You will receive an email letting you know when 911 service is activated at the updated address.
ImpactConnect customers have access to Enhanced 911 (E911), basic 911 or our national emergency call center. With E911 service, when you dial 911 your ImpactConnect phone number and registered address is sent to the local emergency center serving your location, and emergency operators have access to this information in order to send help and call you back if necessary. With basic 911, when you dial 911, local emergency operators answering the call may not see your ImpactConnect telephone number or your registered address. The emergency center may not be equipped to receive, capture or retain your Impact Connect telephone number and registered address, so you must be prepared to give them this information. Until you give the operator your phone number, he/she may not be able to call you back or dispatch help if the call is dropped or disconnected, or if you are unable to speak. Once local emergency centers are capable of receiving our customers' information, we automatically upgrade customers with basic 911 to E911 service.
If you do not have access to either basic 911 or E911 for any reason, your 911 call will be sent to the Impact Telecom national emergency call center, where a trained agent will ask for your name, telephone number, and location, and then transfer you to the local emergency center nearest to your location.
YOU HEREBY ACKNOWLEDGE AND AGREE TO ALL OF THE INFORMATION BELOW REGARDING THE LIMITATIONS OF 911 SERVICE OVER IMPACTCONNECT VOIP SERVICE AND THE DISTINCTIONS BETWEEN 911 SERVICE OVER IMPACTCONNECT VOIP SERVICE AND 911 SERVICE OVER TRADITIONAL WIRELINE TELEPHONE SERVICE. YOU AGREE TO ADVISE ALL INDIVIDUALS WHO MAY PLACE CALLS OVER IMPACT CONNECT VOIP SERVICE OF THE 911 LIMITATIONS DESCRIBED BELOW.
IMPACT TELECOM MAKES NO WARRANTY THAT THE IMPACTCONNECT VOIP SERVICE FOR ACCESS TO 911 WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE OR BATTERY BACKUP POWER WILL BE SUFFICIENT TO MAINTAIN THE SERVICE THROUGHOUT ANY AND/OR ALL POWER OUTAGES.
911 SERVICE OVER THE IMPACTCONNECT VOIP SERVICE IS ONLY AVAILABLE AT YOUR REGISTERED LOCATION IN OUR RECORDS AT THE TIME THAT YOU MAKE THE 911 CALL, AND WHILE CONNECTED TO PROPERLY POWERED EQUIPMENT AND AFTER IMPACTCONNECT VOIP HAS BEEN ACTIVATED.
911 SERVICE OVER THE IMPACTCONNECT VOIP SERVICE WILL NOT FUNCTION IF YOUR EQUIPMENT FAILS OR IS NOT CONFIGURED CORRECTLY OR IF YOUR IMPACTCONNECT VOIP SERVICE IS INTERRUPTED OR NOT FUNCTIONING FOR ANY REASON, INCLUDING, BUT NOT LIMITED TO, IN THE EVENT OF A POWER OUTAGE (UNLESS YOU HAVE WORKING BACKUP BATTERY POWER), NETWORK OUTAGE, BANDWIDTH CONNECTION FAILURE, DELAYS THAT CAN OCCUR IN MAKING YOUR REGISTERED LOCATION AVAILABLE THROUGH THE ALI DATA BASES OR DISCONNECTION OF YOUR SERVICE BECAUSE OF BILLING ISSUES. IF THERE IS A POWER OUTAGE, YOU MAY BE REQUIRED TO RESET OR RECONFIGURE THE EQUIPMENT PRIOR TO BEING ABLE TO USE YOUR SERVICES, INCLUDING USE FOR 911 CALLING. YOU ACKNOWLEDGE THAT IMPACT TELECOM STRONGLY RECOMMENDS YOU MAINTAIN AT ALL TIMES AN ALTERNATIVE MEANS OF ACCESSING 911 SERVICES, SUCH AS VIA CELLULAR TELEPHONE SERVICE.
YOU ACKNOWLEDGE AND UNDERSTAND THAT IMPACT TELECOM WILL NOT BE LIABLE FOR ANY LOSSES INCURRED DIRECTLY OR INDIRECTLY AS A RESULT OF SERVICE OUTAGE AND/OR INABILITY TO DIAL 911 USING YOUR IMPACTCONNECT VOIP SERVICE OR INABILITY TO ACCESS EMERGENCY SERVICE PERSONNEL FOR ANY REASON, INCLUDING BUT NOT LIMITED TO THE 911 CHARACTERISTICS AND LIMITATIONS SET FORTH IN THIS DOCUMENT AND/OR THE CHARACTERISTICS, LIMITATIONS, AND/OR FAILURE OF THE 911 NETWORK ITSELF.
WITHOUT LIMITING ANY PROVISIONS OF THE TERMS OR THIS SERVICE SCHEDULE, YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS IMPACT TELECOM, ITS SUBSIDIARIES, AFFILIATES, OFFICERS, AGENTS, DIRECTORS, EMPLOYEES, AND ANY OTHER SERVICE PROVIDER WHO FURNISHES SERVICES TO YOU IN CONNECTION WITH THE IMPACTCONNECT VOIP SERVICE, FROM ANY AND ALL CLAIMS, LOSSES (INCLUDING LOSS OF PROFITS OR REVENUE), LIABILITIES, DAMAGES, FINES, PENALTIES, DEMANDS, ACTIONS, COSTS, AND EXPENSES (INCLUDING, WITHOUT LIMITATION, REASONABLE ATTORNEYS FEES) BY, OR ON BEHALF OF YOU OR ANY THIRD PARTY OR USER OF THE IMPACTCONNECT VOIP SERVICE, REGARDLESS OF THE NATURE OF THE CLAIM, INCLUDING WITHOUT LIMITATION CLAIMS RELATED TO 911 DIALING, ARISING FROM OR IN CONNECTION WITH ANY FAILURE OR OUTAGE OF IMPACTCONNECT VOIP SERVICE OR ANY FAILURE OR OUTAGE OF THE 911 NETWORK ITSELF.

11. HOME ALARM AND OTHER DEVICE COMPATIBILITY
IMPACT TELECOM MAKES NO WARRANTY THAT (i) IMPACTCONNECT VOIP SERVICE USED AS A COMMUNICATIONS PATHWAY FOR MONITORED BURGLAR ALARMS, MONITORED FIRE ALARMS, AND/OR MEDICAL MONITORING SYSTEMS OR DEVICES, WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (ii) THE SERVICE WILL BE COMPATIBLE WITH ANY PARTICULAR OR ALL MONITORED BURGLAR ALARM(S), MONITORED FIRE ALARM(S), OR MEDICAL MONITORING SYSTEM(S) OR DEVICE(S), OR (iii) BATTERY BACKUP POWER WILL BE SUFFICIENT TO MAINTAIN THE SERVICE THROUGHOUT ANY AND/OR ALL POWER OUTAGES,
Potential Incompatibility with Monitored Fire Burglar Alarm, Monitored Fire Alarm, and Medical Monitoring Systems, and Other Devices.
MONITORED FIRE ALARM AND BURGLAR ALARM SYSTEMS AND MEDICAL MONITORING DEVICES MAY NOT BE COMPATIBLE WITH IMPACTCONNECT VOIP SERVICE.
IF YOU HAVE OR PURCHASE A MONITORED FIRE ALARM OR BURGLAR ALARM SYSTEM OR A MEDICAL MONITORING DEVICE THAT YOU INTEND TO USE WITH IMPACTCONNECT VOIP AS THE COMMUNICATIONS PATHWAY, YOU AGREE TO CONTACT YOUR PROVIDER FOR THOSE SYSTEMS/DEVICES TO DETERMINE COMPATIBILITY WITH IMPACTCONNECT VOIP SERVICE AND TO ARRANGE FOR YOUR PROVIDER TO TEST SUCH SYSTEMS/DEVICES AFTER INSTALLATION OF IMPACTCONNECT VOIP SERVICE. YOU ALSO ACKNOWLEDGE AND UNDERSTAND THAT EVEN IF SUCH SYSTEMS AND DEVICES ARE COMPATIBLE WITH IMPACTCONNECT VOIP SERVICE, THEY WILL NOT BE ABLE TO COMMUNICATE WITH MONITORING STATIONS DURING A POWER OUTAGE UNLESS YOU MAINTAIN BATTERY BACKUP POWER FOR IMPACTCONNECT VOIP AS DESCRIBED IN THESE TERMS. IF YOU PURCHASE A MONITORED BURGLAR ALARM OR MONITORED FIRE ALARM SYSTEM AFTER VOIP HAS BEEN INSTALLED, YOU ALSO AGREE TO CALL IMPACT TELECOM PRIOR TO INSTALLATION OF ANY SUCH SYSTEM. SUBSEQUENT INSTALLATION OF THESE SYSTEMS MAY REQUIRE RE-WIRING OF IMPACTCONNECT VOIP SERVICE, WHICH MAY ALSO RESULT IN TIME AND MATERIAL CHARGES. (IMPACT TELECOM DOES NOT PROVIDE SUPPORT FOR, OR RE-WIRING OF IMPACTCONNECT VOIP IN SUPPORT OF, MEDICAL MONITORING SYSTEMS OR DEVICES).
ONCE VOIP HAS BEEN INSTALLED FOR USE WITH A MONITORED FIRE ALARM OR MONITORED BURGLAR ALARM SYSTEM, YOU AGREE THAT YOU WILL NOT CHANGE OR MODIFY THE INSIDE WIRING OF YOUR HOME OR MOVE OR RECONFIGURE YOUR EQUIPMENT IN ANY WAY WITHOUT CONTACTING IMPACT TELECOM AND YOUR ALARM SERVICE PROVIDER. YOU ALSO AGREE THAT YOU WILL NOT PLUG ANY TELEPHONE EQUIPMENT INTO THE BACK OF THE EQUIPMENT. YOU ACKNOWLEDGE AND UNDERSTAND THAT IF YOU CHANGE OR MODIFY YOUR INSIDE WIRING, MOVE OR RECONFIGURE YOUR EQUIPMENT IN ANY WAY, OR PLUG ANY TELEPHONE INTO THE BACK OF THE EQUIPMENT IT COULD RESULT IN A FAILURE OF YOUR MONITORED BURGLAR ALARM OR MONITORED FIRE ALARM SYSTEM.
BY ACCEPTING THESE TERMS, YOU USE IMPACTCONNECT VOIP SERVICE AT YOUR OWN RISK AND WAIVE ANY CLAIM AGAINST IMPACT TELECOM FOR INTERFERENCE WITH OR DISRUPTION OF A MONITORED FIRE ALARM OR BURGLAR ALARM SYSTEM, A MEDICAL MONITORING DEVICE, OR OTHER SUCH SYSTEMS OR DEVICES DUE TO THE IMPACTCONNECT VOIP SERVICE.
